Terms of Service

The service provider and your contracting party is:

David Parys Tech is a sole proprietorship registered in Poland (jednoosobowa działalność gospodarcza) and entered in CEIDG, the Polish Central Register and Information on Economic Activity. Mountain Web Studio is a trading name of that business; invoices, contracts, and legal notices are issued in the registered name above.

We offer custom web development, AI application development, chatbot integration, process automation, and related consulting services to businesses and individuals (“Services”). Specific engagements are governed by a separate Statement of Work (“SOW”) or project agreement agreed by both parties.

These Terms apply to your use of this website and to general communications with us. They do not supersede an agreed project agreement where those terms conflict; in that case, the project agreement prevails.

Through this website we provide the following free electronic services: access to published content, a contact form, and machine-readable endpoints intended for software agents (documented at /docs).

To use them you need:

• A device with internet access and a current web browser, or an HTTP client
• An active email address, in order to use the contact form
• Cookies enabled for the theme preference, which is optional

Using the contact form is a one-off service that ends when your message is sent. You may stop using any of these services at any time by leaving the site. We are entitled to interrupt availability for maintenance or for technical reasons.

You may use this website for lawful purposes only, and you must not supply unlawful content. You agree not to:

• Attempt to gain unauthorized access to any portion of the site or its infrastructure
• Transmit spam, malware, or any harmful code
• Submit content that is unlawful, defamatory, or infringes the rights of others
• Scrape, crawl, or harvest content or data in excess of what our published agent documentation permits
• Use the site in a way that could damage, disable, or impair its operation
• Impersonate us, our staff, or our contractors

We may restrict or terminate access to the site for any user who breaches these conditions. Where you are a consumer, we will restrict access only where it is proportionate and, wherever practicable, after notifying you.

All content on this website — including text, images, code snippets, graphics, and the overall design — is owned by or licensed to us and protected under the Polish Act of 4 February 1994 on Copyright and Related Rights. Nothing on this site grants you a license to reproduce, distribute, or create derivative works from our content beyond the permitted use allowed by law.

Client work displayed in our portfolio is shown with permission. Ownership and transfer of rights in deliverables produced under a project engagement are governed exclusively by the applicable SOW.

When you submit a message via our contact form or by email, we use that information to respond to your inquiry. We do not sell your inquiry details or share them with third parties for marketing purposes. See our Privacy Policy for the full account of how we process personal data and the lawful basis for doing so.

Use of this website is free of charge. Fees for Services are set out in the applicable SOW. Unless stated otherwise, quoted amounts are net of VAT, and VAT is added at the rate applicable at the time of invoice.

For business customers established in another EU member state and holding a valid EU VAT number, we generally invoice under the reverse charge mechanism, and you account for VAT in your own country. We issue invoices electronically unless you ask us for another format.

If you are a consumer, or a sole trader entering a contract that is not of a professional nature for you within the meaning of the Polish Act of 30 May 2014 on Consumer Rights, you generally have 14 days to withdraw from a distance contract without giving a reason. The period runs from the day the contract is concluded. To withdraw, send us an unambiguous statement at david@mountain-web-studio.com.

If you expressly ask us to begin work before the withdrawal period ends, and we fully perform the Services within that period, the right to withdraw lapses on completion. If you withdraw after work has started, you owe payment in proportion to what was performed up to that point.

Nothing in these Terms limits any mandatory consumer right you have under Polish or EU law. Where a provision of these Terms conflicts with such a right, that right prevails.

If a service does not work as described, send a complaint to david@mountain-web-studio.com describing the problem, when it occurred, and how you would like it resolved. We respond to complaints within 14 days of receipt.

Consumers may also use out-of-court complaint and redress procedures, including the district or municipal consumer ombudsman (powiatowy lub miejski rzecznik konsumentów), the permanent consumer arbitration courts at the Provincial Inspectorates of Trade Inspection, and the information resources of the Office of Competition and Consumer Protection (UOKiK) at uokik.gov.pl. Using these procedures is voluntary for both sides.

This website and its content are provided on an “as is” and “as available” basis. We do not warrant that the site will be error-free, uninterrupted, or free of viruses or other harmful components, and we make no warranty regarding the accuracy, completeness, or timeliness of any content on it.

Content on this site is general information, not advice for your specific situation, and it does not constitute an offer within the meaning of Article 66 § 1 of the Polish Civil Code. Statutory warranty and conformity rules continue to apply to Services delivered under a project agreement.

Where you use this website as a business (B2B), our liability for use of, or inability to use, the website is limited to direct damage and shall not exceed EUR 100. We are not liable for lost profits or for indirect or consequential damage. Liability arising from a project engagement is governed by the applicable SOW.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including liability for damage caused intentionally (Article 473 § 2 of the Polish Civil Code), for death or personal injury, or under mandatory consumer protection rules. If you are a consumer, the limitations in this section do not apply to you, and we are liable on the general terms of the Polish Civil Code.

This site may link to third-party websites for convenience. We have no control over the content, privacy practices, or terms of those sites, and we are not responsible for them.

We may update these Terms — for example, to reflect a change in the law, in our Services, or in the technical requirements above. The effective date at the top of this page reflects the most recent revision.

Changes take effect for new uses of the site from the date they are posted. Where you have an ongoing contract with us, we will notify you of a material change at least 14 days in advance, and you may terminate that contract before the change takes effect. Changes never apply retroactively to rights you have already acquired.

These Terms are governed by Polish law. Where you are a business, any dispute arising from these Terms or from use of this website shall be resolved by the Polish court having jurisdiction over our registered seat in Mielec.

Where you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of habitual residence, and you may bring proceedings in the courts of that country in accordance with Regulation (EU) No 1215/2012.

These Terms are published in English. A Polish-language version is available on request; if the two versions differ and you are a consumer resident in Poland, the Polish version prevails.
